Photocopy is not an infringement of copyright. Decision by Delhi High Court

In a land mark verdict Delhi high court dismissed the plea of three publishers (University Press, Cambridge University Press and Taylor & Francis) against sale of photocopy books in Delhi University On Friday 16th September 2016. Along with this ban on sale of photocopy shop in Delhi university campus has also been lifted which was imposed in November 2012. 

Delhi High Court stated that making of photocopy of the relevant portions of books “does not constitute any infringement of the Copyright under the Copyright Act”.

It was taken into consideration that photocopies at university campus helps students in preparing for their exams and is not a commercial exploitation. This decision has been welcomed by experts though it will hurt publishers commercially but it is seen as benefit of masses over personal profit
